EA sued over Sports Active 2.0

Electronic Arts is facing a lawsuit after fitness firm Active Network has claimed EA Sports Active 2.0 will infringe on its trademark rights.

The California-based company claims it has the rights to the word Active” when used in reference to sports training services and more, according to GameSpot. Active Network registered the trademark in 2008, having used it since 1999.

The lawsuit says this includes providing information regarding the scheduling of participatory sports and recreational activities and sporting events; sports training services, namely, providing personal training schedules and programs”.

The company also claims EA Sports Active 2.0 will perform several online functions that make it a direct competitor to the Active.com website, including the online creation of exercise programs, personal fitness chat rooms and online tracking for workout activity, calories, heart rate, weight and more.

Active Network have requested that judge prevent EA from releasing the game with any of these features that use the term Active”.
